1. Acceptance of Terms

By accessing and using Tarsoft Care ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access the materials on Tarsoft Care's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to reverse engineer any software contained on Tarsoft Care's website
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

3. User Account

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Service Availability

We reserve the right to withdraw or amend our Service, and any service or material we provide, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.

5. User Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material. You are responsible for the content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting content on or through the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Service.

6. Prohibited Uses

You may not use our Service:

  • In any way that violates any applicable national or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

7. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Tarsoft Care and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

9. Disclaimer

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms relating to our Service and the use of this Service.

10. Limitation of Liability

In no event shall Tarsoft Care, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

11. Governing Law

These Terms shall be interpreted and governed by the laws of Malaysia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Mobile App Permissions & Device Access

By installing and using the Tarsoft Care mobile application, you agree to grant the application the following device permissions where required for the Service to function:

  • GPS / Location: To support attendance verification and work-site presence confirmation. You may revoke this permission at any time in device settings, understanding this will limit related features.
  • Camera: To capture photos for task documentation, incident reports, and profile pictures. The camera is only accessed when you explicitly trigger such features.
  • Storage / File Access: To upload work-related documents and save reports for offline use. We access only files you select or that the app generates.
  • Push Notifications: To deliver task assignments, ticket updates, and operational alerts. You may disable notifications at any time through device or in-app settings.

You may manage these permissions at any time through your device settings. Revoking certain permissions may affect the availability of specific features within the Service.

13. Workforce Monitoring Consent

If you are using the Service as an employee or staff member of an organisation that has deployed Tarsoft Care, you acknowledge and consent to the following monitoring activities as part of the employment arrangement:

  • Attendance Tracking: Your clock-in and clock-out times and attendance records will be logged and made available to your employer's authorised administrators.
  • Location Tracking During Work: Where enabled by your employer, your GPS location may be recorded at check-in/out points or during active work sessions to verify work-site presence. This operates only within configured working hours.
  • Task & Ticket Activity: Your interactions with tasks, service tickets, and work orders — including status updates, remarks, and file submissions — are logged and visible to your employer for operational management and audit purposes.

These monitoring activities are carried out on behalf of your employer. If you have concerns about workplace monitoring, please consult your employer's HR or data protection officer.

14. Account Deletion

You may request deletion of your account at any time via the in-app process under Profile > Account Settings > Delete Account. By requesting account deletion, you acknowledge the following:

  • Your personal profile data will be permanently removed within 30 days of the confirmed deletion request.
  • Operational records (attendance, task logs, ticket history) may be retained for up to 7 years as required by applicable law or contractual obligations.
  • Account deletion is irreversible. You will lose access to all data and history associated with the account.
  • If your account is managed by an organisation, deletion may require administrator approval from that organisation.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
